TERMS OF SALE POLICY
1. Introduction
1.1 These Terms of Sale (“Terms”) apply to all purchases made through the De Vere Diamonds Limited (Trading as De Vere Diamonds) website.
1.2 Please read them carefully before placing your order. By ordering from us, you agree to be bound by these Terms.
1.3 These Terms do not affect your statutory rights under UK consumer law.
2. Our Contract with You
2.1 Your order constitutes an offer to purchase jewellery from De Vere Diamonds Limited (Trading as De Vere Diamonds).
2.2 We will acknowledge receipt of your order by email, but this does not constitute acceptance.
2.3 A binding contract is formed only when we confirm dispatch of the item(s).
3. Products and Descriptions
3.1 We take all reasonable care to ensure that descriptions, images, and specifications are accurate. However, as our jewellery is crafted from natural diamonds, slight variations may occur.
3.2 Diamonds are graded according to industry standards (cut, colour, clarity, carat). Variations may exist between independent grading laboratories.
3.3 Hallmarks are applied in accordance with the UK Hallmarking Act 1973 and Assay Office regulations.
4. Pricing and Payment
4.1 All prices are listed in GBP and include VAT (where applicable). Our e-commerce site can also show prices in local currencies.
4.2 Delivery costs, insurance, and any applicable duties are displayed separately before checkout.
4.3 Payment must be made in full at the time of order using approved payment methods.
4.4 In the event of a pricing error, we reserve the right to cancel the order and refund you in full.
5. Delivery
5.1 We deliver worldwide, subject to applicable sanctions and import restrictions.
5.2 Delivery times are estimates only; we are not liable for delays outside our control.
5.3 Risk passes to you once the goods are delivered and signed for at the delivery address.
5.4 We insure all items in transit until signed for by you or your authorised representative.
6. Right to Cancel (Consumer Contracts Regulations 2013)
6.1 You may cancel your order within 14 days of delivery for a full refund.
6.2 Items must be returned in their original, unworn condition with all documentation and packaging.
6.3 Exceptions: the right to cancel does not apply to bespoke, engraved, resized, or otherwise personalised jewellery.
7. Returns and Refunds
7.1 If you wish to return an item, please notify us in writing within 14 days.
7.2 We will refund you within 14 days of receiving the returned goods, minus any deductions for loss of value caused by handling beyond what is necessary to establish the item’s nature, characteristics, and functioning.
7.3 Return shipping is at your expense unless the goods are faulty or misdescribed.
8. Faulty or Misdescribed Goods (Consumer Rights Act 2015)
8.1 If goods are faulty, misdescribed, or not fit for purpose, you are entitled to:
- A full refund within 30 days of delivery, or 
- A repair or replacement after 30 days, unless impossible or disproportionate.
- 8.2 You statutory rights are not affected.
9. Bespoke and Made-to-Order Jewellery
9.1 Bespoke pieces (including those designed with you, engraved, or altered to your specification) cannot be returned unless faulty.
9.2 Lead times for bespoke work will be confirmed at the time of order and are approximate.
9.3 We reserve the right to request a deposit for bespoke work. Deposits are non-refundable once work has commenced.
10. Warranties and Care
10.1 We warrant that our jewellery will correspond with its description and be free from material defects at the time of delivery.
10.2 This warranty does not apply to normal wear and tear, accidental damage, misuse, or failure to follow care instructions.
10.3 Complimentary inspections and cleaning services may be offered at our discretion.
11. Limitation of Liability
11.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited.
11.2 Subject to clause 11.1, we are not liable for:
- Any loss of profit, business, or goodwill; 
- Any indirect or consequential loss; 
- Delays beyond our control. 
- 11.3 Our total liability in respect of any claim under these Terms will not exceed the value of the goods purchased. 
12. Force Majeure
12.1 We are not liable for failure to perform our obligations caused by events beyond our reasonable control, including but not limited to: strikes, lockouts, acts of God, war, terrorism, natural disasters, pandemic, embargoes, or government restrictions.
13. Compliance and Sanctions
13.1 We will not supply products in breach of UK, EU, US, or UN sanctions.
13.2 Orders may be cancelled if delivery would contravene applicable sanctions, trade restrictions, or origin requirements.
14. Governing Law and Jurisdiction
14.1 These Terms are governed by the laws of England and Wales.
14.2 The courts of England and Wales will have exclusive jurisdiction, unless you are a consumer resident in another jurisdiction where mandatory consumer protections apply.
15. Complaints and Dispute Resolution
15.1 If you have a complaint, please contact us at hello@deverediamonds.com.
15.2 We will acknowledge complaints within 2 working days and aim to resolve them within 14 days.
15.3 If we cannot resolve a dispute, you may refer it to an Alternative Dispute Resolution (ADR) provider. While we are not obliged to participate, we will consider engaging in good faith.
